No, that' what the I-601A is for. When she goes for her interview she'll get a 10 yr. ban, but she has an approved I-601A. This waives the ban. She'll get her visa a few days later as long as she has no other issues.

Sorry, I meant to say she has an approved I-601A. It was a typo, I added an extra "has".

Process should take between 4-8 months tops!

File all the forms at once and you should be receiving your LPR card around Sept. as an overstay you dont need a I601 (unless you need a waiver for criminal convictions). It is a super easy process as long as you have plenty of proof that you are in a good faith marriage.

Congratulations!!! It shouldn't take too long for me from the time my packet was received and approval took about 2 months and 7 days..They seem to be moving pretty fast with the AOS.

I must be very new to the forum but can someone explained all those short abbreviations such as EWI, AP, OP, etc? I asked because I am also going through a similar situation. I overstayed my tourist vista since I was 15 years old and received my DACA last year by filing the paperwork myself. This year I am planning to marry my US citizen boyfriend and want to do it by myself or just hire a paralegal for paperwork (my family had paid a big money for my sister's unique immigration case so right now the last time I want to do is to hire an attorney). And I looked at USCIS website and it seems a lot simple than I though. Would someone help me understand more forms by pointing out the necessary forms I have to file? I greatly appreciate your help. Thank you----Linda

EWI - Entry without inspection, you entered US illegally by hopping the fence or stowing away on a ship or plane. EWI makes one ineligible to adjust status via marriage (as opposed to visa overstayers who entered legally).
AP - Advance Parole, permission from the government to depart US temporarily and subsequently re-enter legally as a parolee (using it to return to US clears an EWI).
OP - Original Poster, the person who started a given forum thread.

Anyways in regards to your case:
Since you overstayed your visa and are going to marry your boyfriend and have him petition you for a green card without need for waivers or anything.

Forms to file are the following:
I-130 Petition for Alien Relative ($420) filled out by your husband
I-485 Application for Adjustment of Status ($1070) filled out by you
G-325A Biographic Info Sheet (1 for you and 1 for your husband) ($0)
I-693 Medical examination (must be filled out and sealed by a certified civil surgeon) ($0 but the civil surgeon will likely charge you independently)
I-864 Affidavit of support (filled out by your husband) ($0) (he needs to make 125% of the current US poverty line) (if he doesn't a joint sponsor can fill out an additional I-864, the joint sponsor needs to be a US citizen or permanent resident, does not need to be related to any of you)
Optionally:
I-765 Application for Employment Authorization ($0) (file under category (c)(9)( ), there is no fee and renewals are free while your I-485 is pending)
I-131 Application for Travel Authorization ($0) (if you want advance parole for travel while the application is pending, however use of it after living in US illegally is discouraged)
G-1145 Electronic notification of petition acceptance ($0) (so USCIS will text or/and email you once they get your stuff).

You need to include the following evidence (copies only):
Proof of your husband's citizenship (passport, passport card, birth certificate, naturalization certificate, certificate of citizenship, consular report of birth abroad).
Proof your legal entry (copy of all pages of passport with entry stamp or copy of I-94, if you have neither you can file for a replacement I-94 using form I-102 ($360)).
Proof of your relation (marriage license)
Proof of your husbands identity (passport, state ID, driver's license)
Proof of your identity (foreign passport, Employment Authorization card, state ID, school ID, etc).
Copy of your birth certificate w/ translation if not in English
3 years of tax returns of your husband and cosponsor (if applicable)
6 months of pay stubs of your husband and cosponsor (if applicable)
