Its a common misunderstanding so its not a matter of reading or not but it never hurts to do some research and guys a lot of immigration attorneys offer free consultations (we do) it never hurts to get all your questions out of the way but NEVR NEVER NEVER go to a consult and ask "What forms do i need?" because then you have made your point that youre using the free consult (their time) and have no intentions of hiring.

So what y'all mean to say about advance parole, is that it will remove your entry without inspection away and you will not fall into the 3 to 10 years bar from entering the u.s when u apply for a green card through marriage? Can any one please clarify that to me I'm a little confused. By the way I'm brand new to this page......

It is essentially the same thing, TPS is a protective status they have deferred their removal because the crisis in their particular country... DACA-they have deferred your removal.

I'm really considering doing this. My husband is a USC. I need to do more research.

Now, I have been reading that in theory you should be able to obtain Permanent Residency but I would like to know if someone has successfully done it.
I've talk to a lawyer, but he acknowledged he has heard of it in theory but has never put it to practice. He recommends to wait for Reform (but I am having my doubts about it happening in 2014). He did say, that he has worked with 601A(waiver application, and visa interview), and that it is a difficult process since you have to prove that the USC spouse will suffer extreme hardship.
Going back to AP, I have been reading TPS cases and from what I have understood the Matter of Arrabally and Yerrabelly is NOT settled law. Some people indicate to advance with caution.
So, has anyone been through the process? Anyone has gotten an interview for a Green Card. Any recommendations?
Yes you can. I attended an AILA conference last year. There, many legal representatives brought various cases in which they were able to cure the Unlawful Presence Bar (212(a)(6)(c)(I) only). It cannot be used to cure misrepresentation, the permanent bar, or prior deportations/voluntary departures. It would not be under [i]Matter of Arrabelly and Yerrabelly[i]. You would just simply adjust your status under section 245.
