U Visa & Advanced Parole

Is is the same process to apply for advanced parole for U Visa holders and deferred action? Those who have traveled how do you avoid the ban. I was approved for a U Visa in March of last year. I know it's not Dream Act status. But still I'm a dreamer.

Technically,you were a dreamer since a U visa is a legal status but the rules defining AP should be pretty much the same on the specific reasoning you want to travel abroad.

I think you should actually be looking at having an I-192 filed instead since AP is pretty much limited to one use.If you can remove the ground of inadmissability here in the US you should be able to use it as a regular visa to travel abroad and return.

I filed I-192 when I initially filed I-918. If I go abroad would I just simply go to a consulate and get a physical visa?

Really? Was your I-192 approved and what did you request on the specific Grounds of Inadmissibility to your case?

I forgot to ask what is it you're trying to seek in the end? A U visa from the consulate or simply no travel restriction based on potential prior unlawful presence.

No, an I-192 basically removes any grounds of inadmissibility. If you entered the US illegally (EWI), then you must file the I-192. Thats why you probably filed the I-192 in conjunction with the U-Visa to remove any bars of inadmissibility. I'm pretty sure you have to apply for Advanced Parole, similar to how we do it with DACA.

I got a letter from Vermont center that my U visa petition is placed under deferred action until December 31st 2014 and it states that my application is in waiting list . It also states me to apply for temporary employment authorization if I have any economic necessity. Can you please tell me how long it will take to receive this?

U visa is an actual visa. After you depart US you'd need to stop by the US consulate and have them issue you a U-visa into the passport with which you'd then re-enter US.

This is correct. You cannot AP with U-visa, if you do you will have to consular process back to US. You now are under U-nonimmigrant status if you AP you will have to have the consulate issue you a U-nonimmigrant VISA. I suggest you to not use AP unless it is a great emergency. Wait out the 3 yrs and Adjust your status

And an I-192, it is a standard application that should be included with the u-visa application.

When someone applies for U-visa this are the forms that should be included:

I-918
I-918, supplement B
I-192
I-193 (if that person is either detained and/or has no way to obtain a passport)
Plus a statement addressing, their EWI and describing the incident

The problem with this is U visa holders would still have the 10 year bar if they had more than 1 year of unlawful presence prior if the appropriate waivers were not sought.U visa holders definitely shouldn't do this if it could trigger the bar for them.
