Even tho your visa was valid until 2012, your allowed time in the US could have only lasted 6 months as you entered most likely as a tourist who are only allow to stay for a period of 6 months.

Another thing is that you are not under any lawful status while in the US as a tourist, so you will be fine. That part only applies to people who were in the US under other types of visa like, E-1, E2, F1, J1.

thank you so much for your quick reply!!! so what should we put in question 15 where it asks about the status on june 15? and how do i know what kind of visa he has??? it says USA B1/B2 Visa BCC

It is very likely that he was admitted as B2-Tourist, the only way of know is by seeing the I94 or if the passport was stamped the officers usually write B2 (date) till theyre allowed to stay. So he will put NO because he had no lawful status. Having your visa valid for 10 years means nothing if you have overstayed the allowed time.

he doesn't have an I94(where can he get that??) and his passport was not stamped. I also have another question in form 1-821 in question # 13 where it asks about initial entry date should we put the very first time he came to the usa with his visa or the date when he came here and stayed
