Domestic Violence, difficult to prove?, please help with U visa

Hi,

Imagine a drinking glass flying past your head. You look over and there comes your father yelling and throwing more things.

Fear, depression, mental, and some physical abuse my mom and I have endured. But I decided tonight that I will call the cops.

My mom got hit in the shoulder and I got a scratch on my leg. But over the years...mentally is unbearable. We needed to stick together so we can survive. But this is too much. Little sleep, alot of work, then verbal abuse many nights.

Were from Hungary by the way. I have DACA, but parents are out of status.

Is there hope for my mom and I? We barely have any money.

I called the cops tonight and they filed a report(i hope). Were at a friends place for the night. But what should we do?

Im sorry to tell you this but you have absolutely no chance of getting U-Visa. Im sorry for what you have to endure .

DO NOT GET DISCOURAGE!, First of all, Did your father get arrested? 2nd find your local catholic charities and speak to one of their free attorneys. Let an attorney tell you whether or not its possible.

Please explain why they wouldn't be eligible?

From what the USCIS website states, they would be eligible.

You are confusing it with VAWA, which is when you are a victim of abuse by a USC/LPR. U-Visa it doesnt matter the status of the person. As long as they helped in the investigation.

People tend to believe that in order to be eligible you have to be a victim of the most horrible crimes, but honestly with the right representation you can make a case for a Uvisa. We have done it with the most impossible cases that even I doubted but in the end if the evidence is there itll all work out. Noone here is an attorney and as much as some people hate the "Consult with an attorney" comment in this type of situations its your best option.

Now when you say "we have done it before" , who is we?

I got a consultation Friday with the Nunez firm in SoCal.

Any advice/tips?

We as in the law firm I work for. If you are anywhere near San Francisco I can recommend a very good attorney although I'm not sure if they charge a consult fee.
