I was one of the first people to be granted DACA (before august 15th, 2012) by ICE. My current EAD expiration date is set for July 1st. According to USCIS, my application for renewal was received on the 1st of April, and my biometrics appointment was completed on the 15th of May.

I currently hold a job, which is requesting a renewed EAD before the July 1st deadline to avoid termination/gaps in employment. However, my application has remained in the "initial review" processes and will continue to be even past the experiation deadline. I called the USCIS hotline three days ago and was told that they would file a "service request," but it's very unlikely it will help expedite my case (USCIS is reluctant to accept these requests since people in the past have "abused" the service). Today, I called again and was transffered to a level two customer service officer only to be told that they are aware of these pending renewal cases, but that they don't have a timeline as to when they will be processed (said it could between 3 to 6 months just to renew).

Does anyone have any ideas as to what I can do to extend my EAD even if just temporarily? I'm thinking of visiting my local USCIS office tomorrow... I've tried signing up for an info pass appointment but the system always display "no appointments available at this time." I'm worried about losing my job even after submitting my renewal application three months in advance.

Go tomorrow and try to get an extension, on the USCIS website it mentions that they may temporarily extend your benefits if they're taking longer to process your file.

Thanks, everyone. I'm going tomorrow morning to ask about an interim EAD. I'll be back to provide an update.

Hi again,

Yes, I went this morning to ask about an interim EAD card without an info pass appointment (online appointment system never seems to have any available), and was told they don't issue interim cards anymore. Instead, I was told that I should call the 1-800 number listed on the receipt notice (which I have several times already to no avail).

However, I did call the hotline again just to see if this time they would expedite the renewal. At this point, it seems that most USCIS officers are not knowledgeable in the DACA renewal process (always putting me on hold to read up on DACA before advising me to just "wait it out"). When I was transferred to a level 2 officer, I was told that USCIS has not issued a formal timeline for renewal. Typically, it takes up to 90 days for a non DACA I-765 to be processed (if it exceeds that, you can ask for an expedite request), but because this is DACA everything will be based on approval of deferred action first before the i-765. Basically, the 90 day rule for us will only apply after deferred action is approved (which isn't an issue since DACA and i-765 are usually jointly approved).

Lastly, I was informed that after 120 days from the date USCIS receives the renewal application, I could hypothetically qualify for an extension of the current DACA. However, based on my experience and what I've read online, there is not such thing as an interim EAD/extension of DACA anymore. What I think will happen after 120 days is that USCIS will issue an expedite request which may or may not be approved.

As for me, I'm currently out of a job indefinitely. It's a very absurd situation to be in, given that I applied for renewal within the appropriate time window (April 1st). I hope this does not become an issue for others who applied for renewal via the USCIS version of DACA, but considering they are asking people to apply 4-5 months in advance, anything is possible.

This is very concerning especially with USCIS stating that:
Quote:
Note: If USCIS is unexpectedly delayed in processing your renewal request, we may provide deferred action and employment authorization for a short period of time until we finish processing your request. We may do this if you filed your request at least 120 days before your current period of deferred action and employment authorization expire.
However, I am inclined to believe you since you are directly experiencing this. Are you aware of others who have been approved or are still waiting?
