I got a ticket...

I got a ticket for failure to yield that's all it says on the ticket I got. The police officer took my DL and I must appear on court on the 28. Will this affect my renewal. My permit does not expire until January but I'm thinking of applying as soon as I pay my ticket.

The police officer shouldn't have taken your license. The only way he could take it away from you is if he's suspending your license or if your license is already suspended or if it's expired. It's a minor traffic violation so it's nothing to be worried about. I got one several months before I got approved for my work permit and I was able to fight it off as soon as I got my license. You are entitled to a public defendant. Explain your situation to your public defendant on the phone and ask for advice about what you can do about the officer taking the license from you. You can also talk to a private lawyer about putting up a complaint on the officer that took your license.

Advice in court: Attend both of your trial dates and pay all your fees. I can't give you any advise about the officer taking your license but it sounds to me like he shouldn't have done that so look into it.

As far as I was aware only a judge could decide a punishment. It might be a different state but unless he was doing something else that he did not mention then I don't think the officer was in legal ground to take it away. If he failed to appear in court and the judge ordered his license to be suspended that would be legal ground.

As the previous poster said: different states, different laws. In Illinois, cops were able to take away your license and use it as bond to make sure you went to court. This just changed a couple of months ago (last month?) and now they can't take it away but I'm sure in other states they still can.

OP which state are you in?

You can't just give broad legal advice without first knowing the state they're coming from and their perspective laws.

I'm not giving legal advice I just said it was suspicious that they would take the license away on the spot. OP can investigate further with a legal advisor, like I said previously.

Applying for what? Are you within the 150 days for renewal?

Traffic violations, unless it's related to DUI, will not affect your renewal. I got like three tickets, two of them almost back to back, right before my initial DACA application.
