I'll pay the taxes , I have no problem with that. The problem that I do have is will I go to jail or will it be in my record and intefer with my getting my green card ??

Depends, Is your father a US citizen? If so, and if the IRS ops to do it you could be charge with Social Security misuse which is a federal offense. Just have your dad claim it and you pay the fine

I would suggest having your dad get in contact with the IRS right away, the longer this matter drags out, the chances of this ending badly. For example, if your dad was working at same time you were working under his SSN, it wont take long for an IRS agent to wonder how your dad was working two full time jobs at the same time. In that case, a quick call to your employer bring up the fact that you used your dad's SSN which is highly illegal. This could also happen if the IRS call your employer without knowing that you used your dad's SSN, both scenerios could go like this:

IRS Agent: Hi, I am calling in regards to Joe Smith's (your dad) employment from XX-XX.
Company: Joe Smith? We do not have anyone by that name, we have a John Smith (you) that worked here during that same time.
IRS Agent: No we mean Joe Smith whose DOB is XX/XX/XXXX and has a SSN of XXX-XX-XXXX
Company: Yea we do not have a Joe Smith but we have John Smith whose DOB is YY/YY/YYYY and used the same SSN.
IRS: Thank you, we will investigate this further.

Next thing you know the cops or the feds are at your door and you can likely say goodbye to green card.

Why would he let you use his ssn and then not include the W2 in the income tax. That call FRAUD... by not filing the W2 when you were suppose to file them, now will have to pay fines..

sound like you guy were trying to cheat the system and take advantage....

1. If you used your name and your dad's SSN, then he should have filed and paid taxes. If they would have taken out enough out of his check and his he had made less than $7000 (or something like that), then he may not have had to file, but then he wouldn't have gotten any refund either. Either way, he owed taxes and if he didn't pay, you have screwed over your father and are a bad son by not paying what YOU owe. Your dad was being nice to you by breaking the law so you could work.

2. If you used your own name and your dad's SSN, then you and your dad are in for a world of hurt because now the can of worms have been opened. You couldn't file for taxes because it wasn't your SSN, and your dad couldn't file taxes because it wasn't his name, but either way, YOU owe taxes and have really screwed over your dad and you can both face federal charges and perjury. If that's what you did, get an attorney and tread lightly.

I like how you just went to your employer with the new number and thought all it took was changing it. You don't think in 2014 they have computers at the IRS that redflag this stuff?
