Although, this doesn't seem like it as great as I thought it would have been.

It may still help millions, but it seems CIR is still needed (which was always obvious anyway) and I am once again looking toward the future.

They really need to extend parole in place to other people and attach all sorts of waivers to everything else, even if a waiver is not authorized by law, a president is able to pardon anyone, an EO could authorize USCIS to waive otherwise unwaiveable grounds of inadmissibility (or unwaiveable in the given case) under the presidential pardon provision of the constitution.

You would definitely see a whole another wave of legalizations if USCIS would outright say - if you are in US and would be eligible to adjust status if not for non-criminal inadmissibilities, we will waive them. Currently people and employers don't even bother starting a work sponsorship process because why bother the time and effort to do if it will never result in a green card.

An immigration inadmissibility was actually cleared before with an EO, the Carter Pardon for Vietnam War dodgers, since deserters and draft dodgers are inadmissible, the pardon has cleared that.

What if they kids over 18 but are USC?

You know what I was thinking too.

I remember reading some heartbreaking stories about some people not getting DACA approval because they didn't have a year here or there to prove residency...I was wondering...how in the world are those people ever going to get any relief considering that proof of residency seems to be a standard thing.

Would they have to wait another couple years/decades for another immigration relief while they start to build up a paper trail...pretty crazy...

Good point, but everything I have seen is using the definition of family ties as USC spouse, PR spouse or Parent/Guardian of USC MINOR children. Remember there were several articles that came out saying that minors were being turned over to child services because their parents were deported and relatives could not take them?

If the administration goes that route, it's because the argument can be made that these children's rights are infringed upon when their parents are deported. They have people that can care for them, so when parents are sent away, the children suffer irreparable harm. All of this is coming down to what legal arguments can be made in court should Republicans decide they want to sue, which we know they want to.

Yeah, proof seems to be the stumbling block for most people. And it's going to cut the pool of beneficiaries down significantly.

Yeah, as much it sucks, they are going to need to use that kids are not a fault and need their parents card. Which honestly something good to consider. Nothing aside from the death of parents, is worse than being put into child services.


Oh well, looks a lot of people are going to be left out. Even those here longer than 20 years

10 years is nothing. I've been here 25 years and I've been married to a USC for years... I can't wait to get some documents.

Marry a USC, get an I-601A waiver if you can't do the Advance Parole loophole. Waiting until big brother government gives you papers isn't going to work. If you are grandfathered under 245(i) you can always also look for a company willing to sponsor you or try to play the green card lottery (if you're from an eligible country).
