Also, they updated the Policy last week if you haven't seen it yet.

How will it affect us if we are a visa overstay ??

That depends if you were to apply and have approved a non-immigrant visa waiver.I believe it is called I-192 and is valid for up to 5 years if approved but you must always travel with it and the approved non-immigrant visa every time you return into the US.There is also still the issue of the immigrant bar being in effect dependent on how much unlawful presence has been accrued.

It affects both equally.Unlawful presence accrued after 18 years of age is key to knowing how any undocumented is affected by the immigration bars specifically.

I thought that the updated Advance Parole instructions state that a departure from the U.S. with AP does not classify as a departure under Unlawful Presence.

They got rid of that part. But they mostly kept the part where CBP could deny you entry and that AP is no guarantee.

Basically, you won't be inadmissible for having accrued unlawful presence, but you could be denied entry for other inadmissibilities (gang membership, drugs, money laundering, etc.).

Hi, I sent it as express on June 21, got an email saying they received on June 24.
Got another email on July 1 saying they emailed the approved documents.
but did not receive it yet.
So I think it took a week to get it approved, which seems pretty fast.

That's fast indeed. Did you try calling USCIS to see if they can get you a tracking number for those documents?

Yes, I did call them several times but they said there was no tracking number for my documents.

First time I called, the person said it was processed on July 1st, even though my case status from the website stated, "On July 1, 2013, we mailed the documents to the address we have on file."
Second time I called, the person said it was mailed on July 1st.

So I'm just confused who is right.
I asked if they can tell me which address they sent to, because I moved before I filed the application. And I did change my address prior to applying for advance parole, but I still wanted to check which address they sent to, but they said it was confidential so they couldn't tell me.

I guess I just have to wait..
