Any S.Korean Males Traveling on AP?

This might be a long shot, but I have a question about traveling to South Korea on AP as a South Korean citizen.

Here's my scenario: I'm a South Korean citizen that overstayed my visa. I got my DACA renewal approved, and am looking to travel to South Korea this year.

However, South Korea has a mandatory military service for males. Last year, I went to the embassy to defer my military service under the reason of living abroad for 5+ years with a parent. This document was approved, and I was able to renew my Korean passport. The document states that I can defer my military service as long as I don't stay in Korea for more than 6 months in a year, and as long as I don't work in Korea.


Now, I applied for AP under employment reasons. I am employed under a US company and the reason was that we are expanding a subsidiary firm in S.Korea.

Since my AP application has the reason of employment, would this go against the military service defer document? My guess is that it doesn't matter since I'm still employed under a US company and receiving my pay in $$ and filing taxes in the US, but some people are saying otherwise..

How long are you going to South Korea for? As long as you are not gonna be there for the amount of time mentioned I don't see why your military deferral would be canceled.

If I were you, I would contact your consulate and speak to them directly and explain your situation. Korean Government can be anal about people trying to avoid military service so if they want to take you in then they will without hesitation. You know why? because you are still a Korean Citizen.

Unfortunately, I no longer can get my Korean passport because I didn't come here with my parents. Although I lived in US for close to 20 years and I consider myself an undocumented American, Korean Government thinks I came to US to avoid serving in military at a young age...

Either way, you are a lucky guy with a proper passport and having eligibility to get a passport to travel around the world. But, just double check, with your consulate and see if it is guaranteed (maybe written form). You don't want to get stuck out there, you'll lose your DACA and get banned.
