Are their any consequences for working with expired ead? - Page 2

My EAD expires in 1 month and not sure what to do yet in regards my employment.

Wow did they really say that? My employer wants me to work but I was going to let them know that I cant cause I dont want to get into any trouble.

You are violating your immigration status by working unauthorized, USCIS or ICE or DHS can use your SSN to find out if you've been working unauthorized with an expired EAD (this will effect you when you apply for your green card in the future), when you call USCIS customer service, they aren't "Immigration Case Officers" or "ICE Agents" or "DHS Agents" or "CPB Agents" they are "Customer Service Representatives" don't believe everything they tell you, They only read off scripts. You and your Employer can get into VERY serious legal issues, if you get audited by HR you will only be terminated, But if ICE or DHS, you will be terminated and deported because you knowingly knew your EAD was expired, (If ICE agents or DHS agents audit your company) and your employer would be fined with huge fee's for hiring a unauthorized alien for work.

A lot of people work with different social security number before daca. And they put that number down on their first application. So did I. Will I get into trouble in the future?

Why would you put down an unauthorized SSN that didn't belong to you? and why would you follow what other people are doing? With current Immigration laws it might effect you in the future when you apply for your green card for "Misrepresentation and Fraud" When you initially applied for DACA it clearly stated that " Write down SSN's that were authorized to you" NOT "Put any SSN that you have used before that you made up"

You are quite forceful in your comments for someone that is NOT a lawyer. The better response would be to encourage them to contact a lawyer if they are unsure. DACA and future immigration benefit takes into account that most of us didn't do things "correctly" initially hence the reason why we don't qualify for normal immigration benefits. As a DACA recipient, you (or your parents) certainly didn't do things the proper way, therefore you're in no position to talk with such a condescending and judgements tone.

As far as the expiration of work permit thing, err on the side of caution and inform your employer. Solely based on cases I personally know about, purchasing a fake work permit will get you in trouble later, don't know about anything else.

I have a friend who works for Toyota. His EAD was coming dangerously close to expiring so he brought it up to HR's attention. HR spoke with DOJ (not USCIS for whatever reason) and they said something similar to this, HR said they needed 2 things from my friend so they could keep him employed while the application was pending.

It never happened though since his EAD was magically approved a month earlier than what USCIS quoted him on the phone.

They asked me for i94 and my pending renewal of ead which is the i 765 I believe. But I just decided to take leave if absence since my employer offered it to me.

O please I'm informing he/she what would happen with current immigration laws, I'm a paralegal assistant with a law firm thank you very much and I know what I'm talking about. I've dealt with many cases with misrepresentation and fraud and what happens when doing those things.

I'm condemning your attitude, which you made no attempt at even correcting. As someone in this situation, I would expect you to show some tact and compassion even when relaying the truth. It's not what you say, it's how you say it.

For example say "I'm a paralegal assistant and have seen many cases where people get in trouble for "such and such", I'm not a lawyer and I don't know your circumstance but I would encourage you not to "such and such". That sounds like you care, the other stuff you spewed was downright judgmental. Does that make sense?
