Applying for renewal after EAD expired

Hello all,

I'm in quite a predicament that has led me to complete anxiety these past few days. Last week, I realized that my EAD card expired on 1/16/15 and I have NOT sent in my application for renewal yet. Looking up when I should have sent it, of course the 150-120 day rule just had me dumbfounded. I spoke with an attorney yesterday in hopes to help remedy the situation, as well as to seek advice. She stated that it should be renewed, it will just take 4-5 months. But I am skeptical about this reassurance she's telling me.

Is anyone on the same boat? I am truly and utterly in trouble. I currently work as a RN for a facility and I am scared of getting suspended or worse, fired, due to my lax personality for this important piece of document.

Basically what I'm asking is: did anyone get approved after sending their renewal when their EAD card has expired already?

I understand this is a relatively new thing that USCIS has to handle with DACA. I don't want to accure unlawful presence and risk being deported and unable to return to the US for 3 or 10 years.

Please let us know if any update. the whole 120-150 days is stupid to me. If is not expired yet, people should be able renew without a problem.

Check out my timeline. I applied after my EAD expired. My case was approved in 27 days. Don't get your hopes up though it can be totally different for you. It might take way longer than that, some people are past 2 months from expiration without an approval. Just apply and go with the flow. I personally dont think the 120-150 window to apply before expiration is stupid. It makes sense to apply before your EAD expires. I didn't apply on time for financial reasons and am very thankful I got approved super sonic fast.

1) Send in renewal as quickly as possible. You have a year from expiration date to send your renewal. If more than a year passes then you will have to reapply for DACA as a new applicant. This will not at all harm your chances of renewal, and some renewals have happened within weeks (though it is more common to take 3-5 months)

2) Technically with your EAD expired you are not supposed to be working. Some jobs don't keep track of employees expiring EADs and it is not your responsibility to tell them your EAD is expiring. There is a good chance if they find out that they will either put you on unpaid time off while you wait or you will lose your job.

the last 2 times I applied 4 months before my ead expired

I'm too careless and both renewals I've done have been when my permit was expired, the first time it was 3 weeks after expiration, this time I renewed after almost 2 months. Got everything approved in less than a week, just waiting for my card now.

The card expired on 01/16/15. That's 2 years ago. Your app won't be renewal. You have to apply as a new applicant.

I am freaking out too. Applied 2 months before expiration date. Paid $40 and they received it March 1. Waiting for them to cash my check. ��
