Thank you very much! Really appreciate it. I mean I only used TaxAct since it seemed like it got pretty high reviews from what I read two years ago when I was looking for a service. TaxAct also kinda asks you questions its more of a "form" feel I guess. Never had a problem with them though, really like that they also have free phone support if you need them. I would have used that but I didn't want to go through the whole "ummm what's DACA with the tax representative" I would talk to. The real thing that turned me off from TurboTax is the whole nickel and diming me but if that's not the case anymore maybe it's time to switch.

This is my first time filing tax. I'm Single and no dependents. Can DACA qualify to claim Earned Income Credit?

Are we exempted to the Health Insurance? I'm using Turbo Tax and here are the questionnaires and options I chose.

Did you have health insurance coverage in 2014?

I had health insurance coverage all year.

I didn't have it at any point. (I chose this one)

I had it for part of 2014.



Did you have a situation that waives the tax penalty for being uninsured?

Check all that applied in 2014



Couldn't get insurance:
Plans through work were not affordable in 2014. Learn More
Plans in my area were not affordable. Learn More
Opted out of a plan through work in 2013 and couldn't sign up again until 2014. Learn More


Wasn't required to get insurance :
Spent 330 days or more outside U.S. Learn More
Resident of foreign country or U.S. territory. Learn More
Not a legal U.S. resident. (I chose this one)
Health care sharing ministry member. Learn More
Indian tribe member or eligible for Indian health care. Learn More

If you qualify for the earned income credit then you can get it. And you are correct in your selections.

Regarding the health insurance, do we need to fill out the Form 8965 for exemption? I'm using Turbo tax and as soon as I opted in NOT A LEGAL U.S. RESIDENT, it automatically tells me that I'm exempted without doing Form 8965.

As for the Earned Income Credit, is DACA qualified to claim even not U.S. citizen or Resident?

Any help would be greatly appreciated! Thank you in advance

Hello everyone, i am filing my taxes but little confused about the health insurance and penalty. So i started working in august 2014 and my health insurance started in october, so do i need to file form 8965. If so, i would get excemption for the whole year or do i qualify for the insurance i received from my job?

Please i will really appreciate all your help.

Yes, you have to file form 8965 for the months you didn't have health insurance. They give you a maximum of 3 months uninsured out of the year to not pay the penalty.
However, there are many exceptions and for certain you will not have to pay the penalty

Since you started that job late in the year though, you could say that you were unemployed or what not and couldn't get insurance (or that you lost your previous job, if you had one, and that you couldn't afford insurance).

There are many exemptions that you can look into. Heck, if you live in a republican state, you can even claim that you weren't covered because they didn't expand medicaid in your state, even if you don't qualify for it.

ADD: Also, if you are doing your taxes as a dependent, then the person that claims you has to file the form under their taxes.
