I'm going to start saying the check in the DMV web site what are the documents you can use because when i had my appointment on January 02 2015 in my local DMV they told me that i couldn't use my Mexican passport that i can only use my matricula consular but i told the lady that my passport was on the list of documents i can use. She went and checked and apologized saying the this law is new to them so they don't know it very well, so just a tip make sure to check online what documents you can use; because they don't even know what they are doing.

Anyway the same thing happened to me after i passed my test, i was just told the my application was sent to a second review, i was so upset;however i came and i did my research. The Investigations Division diligently enforces laws, rules, and regulations that apply to*new and used vehicle dealers, brokers, dismantlers, registrations services, vehicle verifiers, misuse of Disabled Person Parking Placard/Plates, driving schools or traffic violator schools, and other vehicle-related businesses. pretty much they have to make sure, you haven't applied before for a driver license, or that is really you! Well i call the 916 number in Sacramento, i know it's always busy but i tried till they answered me, and i found out why my case was sent to a second review. My birthday is April 11 but on my passport shows as 11-04 so they put November 04 and that's why my name and my birthday didn't match and my application didn't go through in the system. Im still waiting i called them again on march 02 and they told me they have a lot of cases that it would take probably up to 30 days more for them to send me a letter !

What more do they want?
my application was referred to a second review too. apparently this is happening to most people who are using their passport, because they aren't putting the correct number of the passport (the one on the bottom with numbers and letters, they may have misspelled it) or they put the birth-date wrong like * my case*. my birthday is April 11 (04-11) but my passport shows as 11-04 so they put November 04 and that's why my info didn't go trough and was sent to a second review. if you husband haven't done anything bad, like trying to apply to get a driver licence before it was legal; then he should be fine. i know its annoying but all you have to do is wait for the letter. i applied the first day January 02 and i am still waiting and it's march 07

Weird...my dad showed his passport and had no problems.
He didn't even have to do his driving test. He just showed his out of state license from 10 years ago. He received his paper license in Jan 2 and his card 5 days after.

They are pretty slow. What you can do is call them until you annoy them. Thats the only way they'll work on your stuff. I had a problem where they wanted me to send new EAD to their legal department and they would just tell me next week, next week. I was like this for like two weeks until I kept calling them everyday. I think by the end of the week, the few people there knew my name. Not to mention it would take me like 20 calls just to get through...this was the only way they saw my documents and sent new license with appropriate expiration.

So they can't fixed it if you go to the dmv office and have them correct your birthday?
I read in another thread that another person have her/his documents checked again and they gave her/him a permit. We're gonna visit another dmv and see if they can help.

I went to the DMV with my Mexican passport and my previous DL. I took the renewal knowledge test. It has been less than two weeks and I just got my DL in the mail.

They said a consular and the passport would have been fine.
