Adjusting status

Hi all, I'm in a particular situation.

I have a petition under category F-4. My priority date is about 10 months away, however i am not covered under section 245i which means I cannot adjust my status here.
I have bee told that even using advanced parole I still would have to go to the us embassy in my country which means i would be banned for at least 10 years.

The question is... Are there any actions that Obama can take alone that would help me adjust my status ? I'm not talking deffered action.. But other options.

No the president cannot intervene through executive power in the visa bulletin. Unfortunately your sibling (category F4) cannot file a waiver for your unlawful presence so theres no point on requesting an Advance parole to attempt to obtain your visa. I am sorry, it kills me to see how many people wait for such a long time only to find out they cant use the petition.

Approved- 01/30/2014
EAD recived- 2/06/2014

June 2014- went India on apdvamce parole
July 2014- came back with no problem

Stamped my passport Paroled in July 2014


File I-130, I-485, I-765, I-131 on 09/10/2014
Recived- 09/15/2014
Bio done- 10/10/2014
I-485 ready for testing and interview - 10/15/2014
I-765, I-131- approved 10/21/2014

Waiting for interview notice

Can we apply for AOS after our paroled until date has expired? The purpose stated on my paroled stamp says "DACA". Will that be a problem?

Good Luck Sing!!

My situation was very similar.

Left in may 2014 for a one day business trip to Toronto ( Cleared my EWI)
sent in my I-485 2 weeks later.
Had my Marriage Interview in October, and one hour after my interview I was approved.

Been married 10 years with one daughter.

Looking forward to exploring the world this year with my Wife. Going to Mexico and Italy.
