I just got hired by a mid-size firm and as part of the employment process I have to fill out an application for background check. One of the question is city and state of birth. How would it affect my process. I dont really wanna tell im under DACA. Im scared that once I input my city and state of birth which is outside of the U.S. they might ask my passport which i dont have a valid passport. Did anyone go through similar experience? Mind sharing please how to handle this?

if anyone needs to know if you are daca it would be your employer. no reason to get fired for not filling out or even lying on a application. when you have to fill out if you are foreign they are going to ask for your expiration date and number. at that point you have to show them your ead and social security number. i dont see how they couldnt know you are on daca. they probably wont ask if you are on daca, probably just assume. you are legally authorized to work so why be afraid.

When you said fill out because Im foreign, are you referring to I-9 verification where asking my passport number and expiration? If so what should I say to them?

You have a legit SSN and an EAD. No need to worry. If it's a discussion opened up by your employer feel free to elaborate as much as you feel comfortable with.

Thank you guys for the feed back. It really gives me confidence! I'm just a little nervous as I've never been in process like this. But like you all said, just hand in the EAD. Hopefully no passport required. Fingers cross!

I've always had background checks done for all the three firms I've worked at. My last two employers, both very large companies, knew I had an EAD through DACA (I had to tell them when their immigration teams asked me to elaborate). Neither companies cared and frankly can't really fire you if you're DACA as long as you have a valid EAD. I've never had to show my passport either.

Thank you. I wish they won't ask to elaborate.

My suggestion is to be honest that you are under DACA, I had the same concern when I applied for my career position. Although, my gut feeling was to not disclose my DACA status once they ran a background check all my info came up under my previous arbitrarily SSN, so I had to explain to them the situation, before approaching them I checked with my lawyer on how to sort this, my lawyer suggested I tell them its a new SSN and you are under DACA. I recall I came across a case where an employer denied a fellow "DACAer" employment, the case went to court and our "DACAer" won the case, so I'd just be honest about your current status.

Thank you! In my case this is my only social security and never had one before. I asked my friend and he told me as long as I provide the EAD and social security, then these should suffice and no passport required. I just hope that they should ask for more information on how did I obtain my working permit. If they do then I just have to be honest!
