I am hoping to the get some advice.

I have an approved I130 petition but I lost the final approval notice.
I have a letter from USCIS notifying me of my case number, priority date and proof of payment.
I also have a letter from the NVC with a visa number available.

I am now able to file for AOS (I485) but they ask for the approval notice.

I am wondering if I can send all of the above plus the email I received from USCIS letting me know my petition was approved.

Thank you!

PS. I know I can file The I824, but It cost $400, I might as well file a new petition if it comes to that.

Do you have a copy, did you file with a lawyer, do they have a copy?

Other than that you can try a FOIA request, or the I-824.

NO! I don't have a copy. Honestly I don't even remember receiving it. I filed it on my own and thought the email would be enough proof.

Okay, from my quick research you can try submitting I-485 without the approval notice, instead provide an explanation to why you don't have the I-797 for the I-130.

At the same time you will file an FOIA request for your entire A-file which should contain the approval notice.

Now, I-485 will likely get an RFE, however you should get the FOIA done by then.

So instead of paying $400 you'd rather submit a new I-130? Mind blowing.

An I-130 cost $420..the I-824 cost $400. A new i130 I can submit with my adjustment of status and possibly be a green card holder within 6 months. Or apply for the i-824 and wait a few months for one sheet of paper. In the meantime the law can change and I won't be able to adjust status based on my recent parole.

Nope not mind blowing.

PS. I can submit what I have as proof of i130 approval and request the FOIA at the same time like the person above recommend. I spoke to an attorney that said he has done this in the past and during the interview his clients gave the notice he requested under FOIA.

Hi did you ever get approve without your approval notice? I'm in the same situation and I don't want to file for a duplicate.

With my I-485 I sent the email I received from USCIS letting me know my I130 was approved. I also printed the "my USCIS case search" page since I had the case number.

At the same time I filed a FOIA asking for a copy of the approval notice. It took them about 2 months to reply to my request.

When I went to my AOS interview I brought the copy I received from my FOIA request but they never asked for it.

So, yes I did get approved.

Were you able to get the approval notice via FOIA? If so, how long did it take you to get that copy?
