Can an Employer get in trouble if they write an affadavit?

Can an employer get in trouble if they write an affadavit for someone who works only for tips?

My boyfriend is applying for daca and he was going to get a letter from his boss stating that he was here the past three years. I'm just worried that his boss might be in legal trouble for hiring off the books.

Anyone have experience with this?
