Hey guys,

Just recently I returned from Canada with AP. Concurrently, my mother has been scheduled for her N-400 interview. If she passes, she will become a US Citizen. I have an approved I-130 through her, and I also qualify for CSPA using the formula given by USCIS and I did seek to acquire adjustment within 1 year of visa availability. I've also taken note that by my mother becoming USC, it may change my category.

My previous I-485 was denied because an I-589 that I was listed under as a child of my mother was not a candidate for grandfathering under 245(i). I was not put into any sort of removal proceedings after the decision.

What can my next step be?

I appreciate any input.

SKycap - your mother was under 245(i) and you were denied ? I am asking because my mother is under it and they have told my sister and I we can adjust status and file under her 245 (i) I was always skeptical which is why I just traveled with AP but sister haven't and one is getting married in Nov.

My mother did not adjust through 245i. Her I-589 was denied - Eventually, there was a court hearing in which she was granted PR. I'm honestly not sure how it went from a denied I-589 and then to court - but that's how it happened. I tried to adjust using that denied application, since I am a child of the main applicant, through 245i.

Her PR card reads as category Z13 - "Alien granted suspension of deportation (other than a crewman) and adjusted as an immediate relative of a U.S. citizen or a special immigrant. "
