Applying for Green Card after DACA

Hey all,

I don't post on here often but everyone was always so helpful here I thought I would give it a go before I seek legal advice (something I don't have the money for).

I was approved for DACA when they first released the law and got it renewed 2 years ago - its due to expire Oct 2016.

I got married last year to a USC (April 2015) and we just had our first baby girl last month .

I want to file for residency before my DACA expires so I don't have to worry about filing for it again (this presidential race is scaring me and I want to get my paperwork done before elections start!!)

My question to you all is - where do I start ... does my wife need to file I-130 and then I have to file the rest. I tried to do some research online but I got different answers.

BTW - I entered the county back in 1997 with my Parents on a tourist visa and overstayed.

Please help - you all have been very helpful over the years and I just wanted to reach out and get your feedback before I start!

It's not a law it's not an executive order it's just a memo uscis released to Obama and Obama approved it.



If you're overstayed then your entry was with inspection which will make the process extremely easier as oppose to someone who is EWI. There have been some threads here about this very thing. Either look for them in the search box or I'll post a few of them later here. But yes people have adjusted status thought AP thanks to DACa. And actually don't think you need DACA to adjust. You could have done it with out DACA

Thank you for that information. I had to file for DACA because I got married last year - I'm on my 3rd year of DACA now due to expire next year. Yeah - if you have those links handy would be awesome!

You shouldn't have had to file for DACA because you got married. You don't even need it for adjusting since you're visa overstayed. DACA helps those who entered with out inspection by allowing them to use advance parole. Once they come back their last entry is considered with inspection helping the adjusting throught marriages lots easier. I know friends who just straight skipped DACA and started their adjustment throught their marriage. And now have green cards DACA was not needed since they entered with inspection. I'll look for them ASAP

yeah I understand - but I needed DACA to work and I wasn't married when I first filed 4 years ago - I only got married last year and now am ready to let go of my DACA status and file for permanent residency.
