Obamacare Exemption Guide

Hello Fellow Dreamers,

One of the more popular questions now as we start Tax Season 2015 is how to apply for

the exemption to Obamacare since we are not eligible to receive coverage through the

marketplace and the IRS finally added this part to their exemptions.

To apply for the exemption. You will add form 8965 along with your taxes. That's it. It

will not change your eligibility for tax credits or change your calculation for deductions.

When filling out the form, DO NOT fill out sections I or II. You only fill out

section III. If you are a Dependent meaning that your parents claim you on their taxes

then you do not file form 8965 (your parents have to file it). They should also

add any other people (brothers/sisters/dependents) who do not qualify for insurance.

If the URL works (click to zoom). You will see that on the form 8965, section III, you will

have the name (first and last), their social security number, the exemption code which is

C for DACA/Undocumented, and either "Full Year" or All The Months

checked off.


When you are using tax software like TurboTax. They will ask you if you qualify for an

exemption and guide you through all of the exemptions. You will click the one that says

"Not a citizen/Permanent Resident" and it will mark you with the same exemption. It

should be the same with other tax software. And of course, mention to your Tax Preparer

that you qualify for that exemption.

HI, does this also work for those who didn't qualify for DACA? I aged out and will be filing taxes with my new tin and not sure how to go about it.

Yes. Anyone who is undocumented also qualifies
