Live. Going on outside.

The solicitors for both sides spoke earlier, as well as Steven King, who didn't seem optimistic.

I don't know...Kennedy was skeptical of the feds....but then he was skeptical of Texas. He holds his cards pretty close to the vest.

Quote:
Next up is Erin Murphy, a lawyer representing the U.S. House of Representatives, which appears as a friend of the court supporting Texas’s position.

Justice Kennedy, whose earlier remarks appeared skeptical of the Obama administration’s position, now raises a troubling question for the challengers. Shouldn’t Texas have challenged the administration’s policy through the Administrative Procedure Act? Again, this is a procedural matter with real world impact, because it would delay the states’ ability to get into court while pursuing administrative remedies, probably allowing the DAPA program to take effect in the meantime. Ms. Murphy says the state could have taken that course, but wasn’t required to.

They don't, this is only to hear the arguments. Although, it seemed like the President might get a win if Roberts delivers his vote and Kennedy votes in the affirmative. This won't stop the challenges though. I am sure there will be one based on a technicality.

As I'm reading this, it's odd to me how little the justices know about immigration law and the SG had to explain it.
Quote:
CHIEF JUSTICE ROBERTS: Lawfully present does not mean you're legally present.
Then Alito asks how it's possible for someone without legal presence to work. ugh... I'm kind of lost too. So far it looks like Roberts is just tearing into us.

What? That they know the law well and are just testing the lawyers?
