The most important aspect of getting favorable discretion from USCIS is,"What is true at filing?" Having said that, getting your GED first and then applying would be ideal. I have seen some awaiting decisions for over a year because USCIS was evaluating if their program meets the "currently in school" option. It may be a gamble and a hope that USCIS considers the program attended meets their requirement of 'accredited'. I am not even sure if they go by the Department of Education standard, or they set their own standard of what institution is accredited also. Again, bear in mind that the process requires everything submitted to be "True at filing!".

On another matter, even if an application has been rejected prior, yes, the applicant may apply for the benefit again provided nothing has changed.
