Advanced Parole while waiting for DACA renewal

Hi,

Couple of questions here:

1) Is it okay to apply for AP while your DACA renewal application is pending? I want to travel to Korea in September. My current EAD is active till October and I just submitted the DACA renewal app. I noticed that the I-131 currently on USCIS site is expired.

2) I am a south korean citizen (age 25) with 10 year extension on military service with a valid South Korean passport. As long as I have AP, are there are any causes of worry to enter Korea and come back to US safely?

3) On form I-131 part 3 where it asks for date of intended departure, can we estimate a date and be okay with it as long as the days on expected length of trip covers my actual departure date? OR should I put unknown?

1. You can apply for AP while your renewal is pending. The only issue is if a person doesn't yet have DACA and they concurrently apply for AP. USCIS cannot approve AP when they haven't made a determination of DACA; this isn't an issue since you were approved.

2. I cannot speak as to what issues can arise in Korea. I can say that you won't have problems returning to the U.S as long as you haven't committed any crimes or have a deportation order.

3. Do not put unknown. You should put an estimate to the best of your knowledge. You will have mentioned the timeframe of your travel in your letter and evidence and USCIS accommodates the AP to that. It is best to apply for AP at least 3 months of intended travel to ensure proper processing time. Really think about when you will need to travel (research airline prices, best time to travel, etc)

Thanks for the reply!!! For #1, I am worried my biometrics appt will fall while I am abroad (although I believe most biometrics are within 2 months after applying for renewal right?

For #2, I figured as much. Anyone else on the forum a Korean citizen male?

Oh and can we use the current form I-131 to apply for AP? It's expired but there is no new one up.

You can only use the current form if their isn't an updated version on the USCIS website
