"Please note that a small percentage of immigration applications and petitions have unresolved background check issues that can delay adjudication."

So is this common practice or related to the data loss? They are making it seem like this is standard protocol.

Studying the spreadsheet, most cases in March have been approved by the Nebraska Center. March 27th been the latest one. Most cases in April are still pending with only one in 4/1 been approved today 8/18. If the spreadsheet is right, then it proves that NSC is taking its time, but it is following a path month by month (with few lucky exceptions). But most -most- cases in March should be approved by now. It's obviously they are not taking expiration as a consideration (since I am from the 8/17 batch), but i kind see their progress. I would seriously doubt they have lost information otherwise they would have already contact all cases in Feb and March regarding their BIOS, and so far there is no case reported. Also, most people in this website stopped checking once they get approved, which would explain the few on the spreadsheet that haven't updated their info. Please keep that spreadsheet up to date, it serves as a good reference for future applicants.

Hoping to get some input. I am scheduled to start a new job in November. I was recently contacted to fill out an application so that a background check can be made by the company. My DACA/work permit have a notice date of 4/12 and I expire 9/4, so it seems to be in the batch of delayed applications.

Would it be wise to let that company know the situation? I guess the real question is, what do they look into in a background check and will the fact that my expiration date is 9/4 show up?

The SSN number on the application will match my name and all my references will check out. My ideal would be to show up on day 1 with a renewed work permit and leave it at that. I would imagine that I would be renewed by then. Any feedback is appreciated. Thanks.

Another interesting fact is that people after 4/20 have also been started to been approved up to the first week of May, which shows that discontinuous gap for the "delayed" cases. This means that cases on that April gap are slowly been approved, alongside cases from May, which are at normal speed. Few in June or July cases, but most are still pending.

Don't even worry about it. Background checks won't reveal your immigration status. They won't even know about your future expiration date until you fill out your I9. But like you said, you start in November so you should feel pretty confident that your DACA will be renewed by then!

We don't know why USCIS has not contacted these applicants since it seems unlikely that they will be able to retrieve the corrupted data.
NotAPro got his biometrics 122 days after filing, so not all data was hopelessly corrupt and lost.

They may not want to process you as a hire without a current work permit.
If you don't tell them about it until they ask for it and it's still expired, they may just turn to the second best applicant, however, if they believe you that you will get your new card before your start date, there should be no issues.

...that assumes you WILL get your card by November, which you should.

called USCIS yesterday and Tier 1 officer told me that there are 25 days left for them to process my case...
received 4/11/16
bio 4/20/16
exp 9/7/16

if they are correct mine will likely expire.. I've contacted NILC, 3 SR and nothing happened so far.. I wonder why this isn't on the news I'm likely going to lose my 6 figure salary and I've been told that they will rehire me but I don't like being exposed or not performing for my company
