Landlord asks for citizenship and ID

Hello. I'm a 1st time applicant haven't received approval, yet.
Sent in my application back in Feb. 2016. Bio. on Jul. and no news, yet.

I don't know how long it will take to get the approval...
But my apartment lease, which I lived in for more than 4 years, will be up at the end of October and they are asking for all the tenant's citizenship and valid ID for renewal.

I did have my Driver's License when we moved in but it got expired in 2013...
Will it be ok to show my passport from my home country?
Is it legal for them to ask for my legal status in the States? (I'm in TX)

Hopefully, I get approved soon so I don't have to be worried all the time at these kind of situations... so frustrated...

I am not sure whether they can ask by law, but either way, they can give you a 1 month notice and kick you out without reason (at least in my city). If my landlord asked I would move out immediately. No one needs to know that information except the government.

It seems like a racist agenda since everyone assumes "illegals" are Mexicans, your landlord is definitely trying to avoid them. I would move out just to be safe and far away from a shithead who will call ICE on you the second Trump gets elected.

they can ask that question. However it is illegal for them to kick you out based on that alone. My advice is to answer honestly and if they evict you then you can sue

How would you sue if they don't need a reason to kick you out but choose to do so anyway?

The problem is I'm living with my brother's family who is a permanent resident and his wife is USC along with their two kids. I'm afraid it's going to affect them also if they find out about my status. That's why I cannot come clean to the landlord about the whole waiting game of EAD card...

Lease will be up in the end of October, so hopefully I can figure out what to do before that.

Besides, we're asian and mybe that's why they were asking for citizenship?
I'm going to call a local lawyer to see if this is legal in Texas for landlords asking citizenships of tenants.

They can't base their decision on national origin. It's against the Fair Housing Act

Is this a private landlord or property management? There's no reason why they need to ask for citizenship to renew leases, sounds like they are just being jerks.

Asking for citizenship status and guidelines that fall under Fair Housing are two different things.

You don't have to accept a person without legal citizenship. There's no laws against that, you just can't deny a person based on the characters described under the Fair Housing Act -- religion, source of income, gender, familiar status, and race/ethnicity.

Property management company... we've living at the same apartment for more than 4 years now... Never asked about citizenships before until this new manager came in. My brother will send in a copy of his passport to test if the manager will ask about his status. Hopefully, my DACA get approved before signing the lease renewal... So nervous and frustrated...
