Need some advice. I applied on 06/05 (105 days ago today) and my case has not been updated ever seen my biometrics. My sister applied 3 weeks later, and she already got approved last week.

I expire on 10/23 (this sunday) and I have not heard anything about it. I called them today and this really nice T1 agent advised to put a service request without me asking. She asked me several questions and then gave me a ref number and told me to call soon if I didn't hear back from anyone.

My job is asking already for it and want an answer by Friday and not sure what to tell them. Should I just resign and quit? I am not sure what to do anymore. Any advice would be really appreciated.

First of all, if you haven't read already, most applications are delayed as this time around, USCIS messed up big time and are working a backlog of applications, so your case is not unique. At the moment, everything is touch and go, and what has been happening is that DACA applications are getting approved on or days after the day they expire, but permits being made and mailed out is also backlogged. The only good thing is that all people that have gone through this already seem to report that their permits and their DACA approval dates are the same, so say if your employer is okay with and you get approved, they may accept your DACA approval notice as evidence of approval.

As far as what you should tell HR, tell them about this delay and be open about what might happen. They can check on the USCIS website about how delayed they are. Unfortunately, it's up to them to decide what to do with your position. The only thing I can tell you is that you should be able to work until the day your permit expires. Some people have been able to stay and work, others have not been so lucky. Also, remember, you technically should not work without a valid permit, but many people here have, so it's up to you if you want to run that risk.

As far as what you should do next to help your application might be to call USCIS and talk to a tier 2 rep to see if they have looked at your case yet. Hopefully they have and you get approved this weekend. Others have called their congressman or emailed IRLC to see if they can help.

Looks like you should be getting approve any minute now, be patient. You might have to go on unpaid leave until you get you're EAD card. I am on the same boat, I renewed in mid july and expire Monday 10/24 and will go on leave Monday. Stay positive and stay busy, im actually glad I get some time off, I can focus on school more, start working out again and do some things around the house that I recently bought. WE WILL ALL BE ALRIGHT JUST STAY POSITIVE AND KEEP OUR HEADS HELD HIGH....

It's been frustrating for many of us as well so you aren't alone. Like turmalina said, hang on and try talking to your HR/Manager. If they are willing, there are loopholes you can use to stay in work.
A couple of options:
Go unpaid for a while, then your employer for some reason gives you a fairly large bonus for your hard work over the year once your document is here.
Switch to contractor, you aren't on payroll so technically you aren't an employee by law, no legal issues for your employer.
Or they might just risk keeping you regardless, there is a fine if they are audited and caught but first time fees are pretty low, it gets higher the more offenses a company has.

My employer just talked to me today and said unpaid leave is an option. They are kind of sad since we are a small team and we can't afford to lose someone out of nowhere, specially right now since we have so much work. But not much I can do

Waiting to hear back from the SR I submitted through the phone on Wednesday. See if that helps at all. The second T2 I talked to said everything should be resolved before Nov 5. Not sure how he came up with that date.

What date was your biometrics done? I feel like you should be getting approved very soon if that biometrics date was over 2 and a half months ago.

Biometrics done in July 20th. Crossing fingers I get approved very soon.

DId you send a service request? I submitted one and got approved about two weeks later. Not sure if it was because of the service request but I've heard on here that usually it takes about two and a half months after biometrics to get approved. Very bizarre to see you're still waiting. Sit tight and keep checking this weekend both on ELIS and USCIS case status! If you do get approved..you can submit a screenshot of that to your HR department and explain them that you're EAD has been renewed and that USCIS is just backlogged so it will delay getting it in the mail. Good luck.

Just an update. I just got approved the 10/23 (the day I was expiring) and my employer was super nice to let me keep working without pay and getting a bonus once I received my card.

I hope everyone hears from their case soon, and wishing everyone tons of luck. Thanks everyone for the support while I was waiting, I will still lurk around and help people out.

This makes me feel a little better about my case. I have been extremely stressed out over the past two weeks. When I filled a renewal 2 years ago. I received my card just two weeks before my expiration date. This is my third renewal and its been going bad.

Date Received: July 5th, 2016
Biometrics: July 25th, 2016
And I am still pending approval currently and my card expires this Sunday Oct. 3oth,

I have been severely depressed and anxious. I am about to have to go on suspension at my job, I work for a Hospital and I am the only one providing for my family and paying my mothers house and bills.

I submitted a service request over the phone, and I have called and checked my status everyday. My lawyer even put in an online service request for me today. I am so scared this is going to take longer.

I am currently pending 112 days as of today.

Prayers to all of us fellow dreamers that have to go through this kind of awful stress. May God be with us all in this hard times.
