Does anybody know if anybody has applied DACA > AOS with inspection, without a lawyer? i feel like its a pretty straight forward process, but damn.....

I have done it for others but AOS, US citizen to mother. It turned out fine. Green card in less than 3 months.

You're right. But at this point how can I clear that EWI? Emergency AP? I don't have a legitimate reason to travel ouside the country. In any case, how difficult is it to prove one needs to travel?

I'm as lost as you. My only hope is for DACA to remain which is very unlikely.

If you are in my situation, I made a table to show which forms we filled out. We did this through a lawyer and I did my biometrics 2 days ago so I know this is correct.

if you don't mind sharing, how long did it take you to receive your biometrics appointment after you submitted your application?

i ask because we submitted our application in mid August 2016. we received a letter in September saying they had received it. nothing else as of yet.

the uncertainty is big - especially because i am set to start graduate school next year, and i want to file for FAFSA so i can take out a loan. of course, now this is secondary to the uncertainty created by Trump.

anyway, i digress.

this is partly why i wonder what your age is.

i am not religious, so my opinion may be influenced by that. however, that said, maybe plant the situation to your family from a different perspective, rather than from a deviant one: you need to do it this way in order safeguard your life in this country.

from what you write, it does not sound that you want to go this route to go against your family or because you do not care about what they think and feel; in fact, it is the opposite. you sound very concerned, so here, maybe you should tell them just that; that you understand and want to honor their beliefs, but that this is a very tricky situation that may not allow you do so for now - however, keep in mind you can get married through the court and have a religious wedding later.

i got married through the court last December and did not even tell anyone, because i did not deem it necessary. we got married because we love and each other and want to be together - the only reason we expedited our decision is because far more ahead than i in life in terms of education and finances, so in order for us to live the way we want to, i need to break through, so to speak.

what concerns me here is not your family but rather that you are saying this is not something that you want. if this is not something that you want, rethink what you are trying to do.

as mentioned by MIdreamer, clearing your EWI should be your first step, should you decide to move forward.

there is a possibility of obtaining AOS without clearing your EWI, but that would consist of moving back to your home country while they reach a determination or of meetings the requirements for the former condition to be waived. both of these scenarios are more difficult, especially the latter.

these all could be big obstacles. my suggestion is to make a list of all the things you would need to do/change and brainstorm ways to confront them, should your BF turned husband not be able to carry yours weight, so to speak, for the next 6-12 months post marriage.

Hey guys,
as many of you I'm a bit nervous about our immediate future. USC gf and I have been together for a long time and we've talking about getting married next summer/fall but with the election results we are going to do it sooner. Early January most likely.

AOS via marriage is a bit complicated for me as I'm EWI. I thought about it clearing it last year via AP but during my research process I found out I have a deportation order from a court case we didn't go to in 2000, I was 12 at the time.


My plan is the following:
1. Close removal proceedings > I retained an attorney yesterday to do this. Attorney said there are options and we will go through all of them but first have to obtain my case files. Takes ~2 months.
2. Travel with AP to clear EWI. This is dependent upon still having DACA sometime in Spring 2017.
3. AOS via USC Wife

Has any of you been able to AOS with a similar situation? Or are you in the process?

Thanks! That's what I had figured. Freaking sucks that I had no reason to get AP or else I would have in order to have been able to avoid this crap but meh you gotta do what you gotta do.
