No, They ask you on your first day.

Or at least that is how it should happen. You fill the I-9 and you are good to go.


I have not heard of anyone who has been asked for documents prior to employment.

Not all big companies view you as disposable as someone mentioned earlier.

That's not how it is. HR verifies your employment prior to hiring you by asking for copy of papers.

Then on your first day you bring it in a hard copy.

You don't have to disclose what your specific status is, you only have to tell them you're allowed to be employed without any sponsorship. This question is typically encountered when first applying for said position. Only exception is when the job requires a security clearance as often a citizenship is required to obtain these clearances.

It is against the law for an employer to ask you your status. Don't volunteer that information as you never know who you're dealing with.

As far as I understand this is illegal. They should not ask you for any copies of anything prior to completing the I9.

They are only allowed to ask.

Are you able to legally work in the united states without sponsorship.


You should answer, yes.


End of story, anything beyond that is not allowed.

Unless they assume your DACA will need sponsorship (some can argue it will) and then rescind your position when they see the EAD of 2 years.

Happened to me.

Sounds like I wouldn't want to work there. Besides, telling them upfront would have left you with the same result.

But they see you have an expiration date on your card. That is where the concern is.

Yes, visa overstay. But virtually anyone can do the same if you clear your EWI with AP. Of course, you'll need a USC / PR parent and a company willing to put you through the process.
