: 1) keep DACA in place for six months to a year and have Congress pass a fix (perhaps as part of a larger border security bill)

issue i see here is if after six months to one year congress does nothing (don't mean to be pessimistic but we all seen immigration bills go up in flames and nothing happens) DACA is then rescinded we are then screwed again, right!

Problem I see with option 1 is it has to be instantaneous ie. they rescind the order, pass the bill. If time passes, things run super slow in congress and won't be surprised if they come to a halt. Even protests only remain in focus for a day or two and everyone else goes back to their life. A bird in the hand is worth two in the bush.
Second option is better, but looks unlikely as they want to push for congress authorized action and not be "unconstitutional"..
For starters, glad these options are even being discussed and not something along the lines of get the heck out, self-deport etc.
Hopefully, an option "everyone is happy and proud" works out. Fingers crossed.

I hope this is the case. Allowing current DACA recipients to renew because they are grandfathered while ending the program for new applicants would technically meet the campaign promise of ending DACA.

Actually, there might be a legal technicality here for us to keep our EAD's. From what I know, you can have an EAD as long as you have a "case pending". Cases usually start when you come into contact with ICE and are referred to court, and there the judge can grant administrative closure, Prosecutorial Discretion, or Deffered Action (like DACA). When someone gets PD, Admin Closure, or DA, they get to keep an EAD and renew each year because even though their case is no longer on the active docket, the case is still "ongoing" until a final decision is rendered. We were granted DACA and on the approval notice it says something like "USCIS has decided to defer action in your case". Meaning we already technically have an open case that has now been deferred thanks to DACA, which is why we qualify for the EAD in the first place. If they cancel DACA, then your case is no longer deferred, but it still exists and would be considered ongoing even if you haven't been served with an NTA. So if you have a case and it's no longer deferred the case itself doesn't go away, so you are still technically entitled to an EAD because of your "ongoing" case. If they follow this reasoning they can tell people that DACA is over and the people who had DACA are renewing their EAD's because they now have ongoing cases. They just haven't gotten around to serving us with NTA's. Does this sound plausible to anyone?
