I've seen AP cases being approved in less than a month.

This is driving me CRAZY!
My DACA is coming due in June as well so I have to renew that...but if I get AP

I would be submitting me AOS instead. Maybe both just to be safe lol

Yes I just saw someone get approved on the Facebook group called advanced parole someone send the application on 03/23 and got approved on 05/12 and he already has his documents on hand. That's awesome!

Hope all is well. I have a question. I'm from small Asian country and I have been in the US for 17 years. I received my DACA in Oct 2012 and have been renewing since. My EAD is good until 08/2018.

My grandfather passed away recently and I would like to come and pay my respects. My father is also not doing too well; I have not seen him since 2000. I spelled this out on my I131 form.

My question is twofold:

1. My application was received on May 1st. I'm planning to travel on June 18th or around that time line. Is it possible to travel out without the actual AP document in hand? Do theyt check this when you leave? The rush is that I would be very late for my family grieving period.

2. Once you receive the AP, how long is this valid for ? Is there a requirement that we stay within time? say 180 days (over 180 may affect DACA status)?

I also did not do the expedited application like normal people. Is this extra than the $575 fee I shelled out?

Thanks all
1. I think it's unlikely they'd approve that in time, they take about 3 months at least to approve an I-131. You can't leave without AP, if you do - you lose your DACA and trigger a 10 year re-entry ban. Yes, they do check it, even if you do somehow play the system and get the AP after leaving and use it to return they'll catch it when you file for renewal or for adjustment or anything else.

2. Generally they give you however long you asked for. You ask for a month they'll give you a month. General advice is to ask for 2-4 weeks more than you really want. That way you have some wiggle room in the event your plane gets cancelled or something.

3. It's not extra, however in such a case you need to schedule an infopass with USCIS, bring all the stuff you submitted and argue that you need AP right now and can't wait for regular processing. The cases where you can get it are limited to compelling humanitarian and economic needs - so if you have some serious inheritance riding on that you might have a case. Otherwise going to see a grave might not be compelling enough that you can't do it in a few months.

Honestly in such a case you can forget DACA unless you want to burn the $495 application fee. AOS is a period of authorized stay like DACA and they just rubberstamp the EAD and AP approvals as soon as someone gets the case in front of them.

Also, DACA doesn't have any renewal deadlines (like for example - TPS). So if the AOS goes sideways you can always file DACA then.
