On joint motions, I can say I have heard of only two situations that have worked. One included ICE agreeing to jointly terminate proceedings for an individual given an order of removal because of a parent. They would only agree to terminate if the primary individual(the parent) left voluntarily. One final situation involved individuals involved in a scam. Some of the individuals had deportation orders, but ICE agreed to jointly terminate proceedings while they investigated the case.

On sua sponte, I think you might have a better shot, but seems precarious. It gives multiple options and openings to eventually appeal to the 9th.

That is quite the shit storm, I assume you will use ineffective counsel(disbarred counsel) for the MTR?
The disbarred guy happened 8 years after I was ordered removed in absentia. Previous counsel whoever it was just told them to lay low and hide since they had no case anyways.

The counsel never filed an EOIR-27 or anything to link themselves with the case. They just noped the fuck out during consultation. Keeping in mind that was 13 years ago, I have no clue who they are, even if I were to ask the assholes they don't know either. Honestly I'd been better if I was just ordered removed not in absentia because I can't even do the I-212/I-601A combo since the 5 year ban will still fuck me.

I need a higher xanax prescription.

Demise... you and I have literally the same situation. I'm getting married to USC in the summer (GF of 10 years) so I might actually try to do something about this. I got as far as getting my A-File... discussed with attorney and he basically said I was SOL. That he would proceed with the case in I wanted but would very expensive and chances of success would be low. UGGGH. Maybe I'll just look at Canada for reals this time.

If you need a good lawyer, I'd personally recommend this firm. They go out of their way to take complex cases. They are overworked and a bit slow but, a lot of immigration lawyers are complete shit out there. They are also pretty cheap for being in the bay area, midwest prices.
