Hi, this is my story. Now I'm stuck.

Hi,

My name is "Max". I started in high school with no drivers license since I had undocumented status, but then DACA came around and I got it and started college. I then proceeded to graduate from college and had started applying for jobs. I received an offer letter for a company, however after I was required to fill out forms they said they can't take me since I have no Visa and am not a Citizen. They said they can't risk my work authorization not getting renewed and they can't offer me the job.

In short now I am stuck and have no idea on how to use my degree to it's fullest. It seems I won't be able to get any corporate level job.

That is all. Just heartbreaking and saddening that all that hard work was sent to the garbage.

Many Dreamers have corporate jobs. Move on, never disclose DACA status until you are asked to show your EAD first day.

Many threads discuss this on the forum. Companies are not allowed to ask visa status.

That company is not worth it.

I work for a top 10 company and it has never been an issue.

They said it was for HR. The section had Citizenship and Visa Status for me to fill out. Companies aren't allowed to ask for that?

The section went:
SSN/SIN:
Visa Status
Citizenship
.. etc..

I was just given the offer letter and they had me fill out this form. I wasn't even employed by them yet. So they can't do that can they?

Nope, they are not allowed. They are only allowed to ask the following question.

"Are you able to work in the U.S without sponsorship?"

What they are doing is shady...

Move on to the next company and ask me anything if you have questions...

People here work at GE, Automotive, Google, etc... No need to feel down because a shit unethical company that has no clue what they are doing turned you down.

Companies like Motorola want citizens as they deal with sensitive materials.

If they want specifically citizens, nothing you can do.

This is true, jobs that require security clearance are not opened to us. Labor law does not apply to those jobs in which security clearance is required. Those jobs however must be clearly defined as such and the government has a way of classifying them. A corporation can't simply claim that one of their jobs requires security clearance when in fact that is not the case.

This happened to me (Internship), I had to reach out to the recruiters, and they helped me out. I also wrote a letter explaining what DACA was and then the next year I obtained a full time job. I lost that specific internship that summer.

To compensate, I applied as an intern engineer at Verizon for the summer. HR did tell me there can be issues once you go full time because of my EAD. I obtained the internship and also winter internship. Then left that company to go for the one who declined my internship.

Keep in mind, HR checks your work authorization before you go in to make sure you are eligible to work. Then on first day you give them the card so they can take physical copies of it.


Let me ask you this, did the job you applied for say "We do not sponsor" because when they see our EAD they think they will have to sponsor us in the future. Many companies do not sponsor individuals anymore. But according to Demise you can go work for a Chinese restaurant and get sponsored.

Did you try to explain what DACA is?

HR people dont care about the new hire or how the employees are doing, they care about getting their stuff done fast, meet the metrics, and get that bonus.

HR does not need to do this, I agree it is mostly ignorance, but the fact is that when you say, I do not need sponsorship, that is a valid statement. Your work authorization does not depend on company sponsorship.

My advice is always to stand by this fact. Internships are thought because many times they do specify you need a green card at least. Full time employment is different, unless security clearance is needed, then you are good to go. Companies have no business in finding out what specific immigration status you hold, as long as you have the right to work they have to abide by that fact. Glad you were able to get help and that you got a full time job!

If you stop and try to explain DACA you run into the risk that the HR person is some right wing Trump supporter and good bye job opportunity. Unless you know they will be sympathetic then I would keep it straight to the point.

I wouldn't be THAT discouraged, as it has been previously stated... companies shouldn't really be asking if you have a Visa or are a Citizen unless they require SECURITY clearance to work due to sensitive information.

90% of the time, a job application will and should only be asking if you are able to work legally in the US. You will then need provide proof of your EAD card.

HR may ask why it's only for 2 years - at which point you can say "I renew it every 2 years". That's it, no need for further questioning - explaining or proof of visa/residency/citizenship (*UNLESS the job requires it for clearance* - this should be clearly stated on the job description which DACA recipients should obviously stay away from.)

Keep looking, there are jobs out there looking for talent all the time! I'm sure you will find a good stable job sooner or later. I looked for a job for almost six months and found it and I have no complaints!
