DACA, parents are citizen can they petition

Hi, i have the daca also my parents are citizen. Can they petition me without me having to return back to the country. Only problem is i have a illegal entry. Does anyone else have a similar situation and would like to share addtional findings would be appreciated. p.s I been in the country since 1999 never went back.

Yes they can petition you. It is likely you will need to return to your country to AOS. I have an approved petition myself but being from MX the visa wait is 20+ years, so if I AOS through this petition in the future I'm hoping I don't need to go back to a US consulate in MX because I entered the US with a visa. That might not be the case for people adjusting the same way but are EWI.

i read the above link as well. looks like i need a advance parole in order to get a legal entry and qualify for green card. So it all depends on the border protection agent if he/she will let me back in. I just have to get extra jacked up so he/she will feel intimitaded let me in.

You should do advanced Parole...

Regardless... Please do it now... chances are that this will not be possible in the near future. Better try now that is possible, it will make things easier down the line.

thank you i will apply for it theres nothing to lose. Is there a expiration date on advance parole once get it and decide to wait on it due to current circumstances

Well, my advice is to apply for it . Leave at a border point.. and spend a day out. Then come back.. right away. You can kind of study the situation as it comes.


Well, that is assuming you are a Mexican citizen. If not you can fly in and out to your country.
