Single dui may not disqualify you. I asked a Omaha dui defense attorney, he said one dui may not disqualify you, but you do dui another immediately after previous one you may have chance to disqualify.

Single DUI should be deportable. No tolerance should be the way things are.

I believe this attorney is not very familiar with immigration law. This is coming directly from the USCIS website on DACA:

A minor traffic offense will not be considered a misdemeanor for purposes of this process, but it is important to emphasize that driving under the influence is a significant misdemeanor regardless of the sentence imposed. You can find detailed information in the National Security and Public Safety section of the Frequent Asked Questions.
DUI = significant misdemeanor = disqualified from DACA
I may not be a lawyer, but I can't see any way to interpret this differently and DUI will come up on background check.

DUI/DWI will disqualify you unless it was dismissed and you pled to a lesser offense. We have several clients who unfortunately will not be able to apply for DACA because they pled to a DWI.

this, even if your state dismissed it, doesn't mean USCIS won't take a look at it

Well fellow Dreamers, after a DUI Expungement granted some time last year, my DACA Case was approved on March 26th , I received my work permit today. My lawyer did some serious lawyering in my opinion by showing totally of circumstances approach and highlighting I made a mistake in my youth, so glad this came through, I can move on with my life now, thanks to this forum for their support.

dado123 what state do you live in? and who was your lawyer? can you refer him to me pls. my story is similar to yours. i have a dui from when i was young. its the worst mistake ia have ever made. i have learned my lesson. i have not apply for DACA because of my fear of been refer to ICE and get deported. i have turned my life around for the better. currently i am working in my bachelors and want to continue with my education and being part of this great nation.

Qualifying for DACA with a DUI is possible! I went through an attorney because I was also afraid of being referred to ICE. Thankfully everything worked out and I just received permanent residency. November 28 2016 – Biometrics Submitted
March 11 2017 – Approved for Interview
