Sorry to hear that. I think you may still keep your green card but idk if it will look good in the uscis eyes that you get divorced after because I have heard stories about some uscis officers spontaneously visiting you to make sure the marriage is legit. Also, I wonder how would that impact your future application for USC.

Forget about the Congress passing anything if you have started and subsequently attended an interview for AOS. In addition, it would depend on the language of the final legislation. In the past, the language within Dream Act suggest the individual must hold no status, however that could change to include DACA holders but the date would be the big issue.

The waiver process is actually not bad, just as long as you married in good faith, residency is still attainable. I doubt having a relationship for eight years could be seen as not marrying in good faith.

I did not had the interview. I just moved back to my parents house. I think we are done for real.

Would depend on the language of the bill, considering that most require you to have no lawful status, answer is most likely no unless you lose your CPR prior to whatever effective date.

One way off the sinking ship is to enlist in either military branch (Coast Guard is a good option if all you want to do is turn Cubans around in middle of the ocean with 0 risk to your own safety), and naturalize under INA 329.

So you're saying that if I get the conditional GC, and I get divorced and assuming I lose my GC because of not being married, I would not qualify for a relief for DACA? Correct?

No, DACA requires you to have been out of status as of June 15, 2012. It doesn't elaborate anything between then and present, so you could go from CPR to DACA assuming you fumbled a marriage.

You have to go for an interview before you get your conditional green card. How are you going to convince your spouse to go along with that knowing you guys are headed for a divorce.
