Not everyone adjusts through marriage.
and to OP overstay is a violation of your nonimmigrant status. I would still consult with a lawyer. But on the application it states even if you're not sure you can answer yes or no and explain why on the last pages.

Use the additional page to explain. Sounds like yes & yes.
For your second question I put yes, and explained on Part 14 DACA.
