If congress doesn't pass anything and our EAD's expire ALL of us have one option: Create an LLC company and get hired as an LLC company.

Having an LLC company gives you the ability to create an EIN for that company, this number acts like a "social" for said company with the full legal ability to be for-hire.

Some of our employers may be willing to do this, I know mine is. So that's probably going to be my route.

One negative? During taxes we get hit with a "self-employment" tax which can be hefty but it beats not having a job at all. There are ways to off-set it by having deductions (something T does on his taxes).

Otherwise, for some of us it'll be time to look for day-labor jobs again or pending what some of us do for a career, offer house-to-house services.
Thanks for the advice. I will try to seem if I can get hired by creating an LLC, but I don't think my company will be willing to do.

Can you provide some more info on this though?

What are your employers saying? Has anyone's HR contacted them regarding this? just wanted to get a feel for what other companies are doing.

I know my HR is actively monitoring this...and have contacted me about it. I work in a Fortune 500 company... and this is a real concern.

Worst part is that I was thinking of changing employers and am now skeptical....the larger companies definitely have our EADs on their radar. I really hate that C33 code on our EADs

Sorry for the late the response..

But, what kind of info?

You just gotta go to the office where you can create/register an LLC company then go to IRS.gov to create an EIN and that should be enough to give you the ability to be a for-hire LLC company. (Note: an LLC company requires yearly renewal / filing with a fee).

Pending on the type of business (home improvement, accounting, assistant, hairstylist, baker, chef, etc) you may need a license to operate.

In my case, I'm IT so besides college-knowledge, a degree and some self-learning all I need is the LLC / EIN and I can apply to be a for-hire IT company.

With an EIN you will need to provide W9 form which allows the payee to report the money they paid you for services you rendered. You may need to give that company an invoice for work done on a weekly/monthly basis.

Then you will get a 1099 form which you can use to file taxes for your wages, this is where self-employment tax comes into play and if you don't claim a lot of expenses then you pay a 15.3% tax rate for your income after deductions.

Deductions can be anything that you spent to keep the company afloat - anything from supplies to hardware to license fees, LLC renewal, to gas/mileage, etc (an accountant can be better assistance here).
