Welp, I've decided to adjust my status via marriage.

We've been seeing each other for a good year now. Not sure if the duration is long enough for the ppl reviewing my case.

Anyway,

How should I go about doing this...

1)Get married first and then talk to a lawyer or vice versa?

2)We dont plan on having a ceremony (financial reasons), will that be an issue for the people reviewing the case?

3)We don't live together currently. Plan on moving in together at the end of the year. Again, will this be an issue.

Any input would be great! I would call Melania for tips, but i don't have her #.

Seriously though, thanks in advance.

Duration OK

1) Doesn't matter. Just don't tell your lawyer you are getting married to adjust. Tell them you are adjusting cause you are getting married.

2) Not at all. Take some pictures when you are leaving the court house.

3) Probably. Move in together, then send application. Why give them a reason to deny you.

Duration is okay.

1) My wife and I spoke to our lawyer before getting married. As long as you can prove that the marriage will be "bona fide" (legitimate), there is nothing to worry about.

2) No, that will not be an issue. Again, you will have to prove that your marriage is legitimate. Save receipts of trips together, pictures with each other's relatives, friends, etc.

3) Should not be an issue. My wife and I moved in together a couple weeks before we got married. We submitted documents showing bank statements, rental agreements, utility bills, etc. with both of our names on them

I would say get married and send in the application first and worry about moving in together later. I'm saying this because it will take around 8 months to hear anything back from USCIS now. You can work on proving your "bona fide" marriage while you are waiting.

Are you overstay or EWI? The process and wait time are very different.

Hey everyone, do you know of anyone who's adjusted status without changing their last name (wife taking husband's last name)? I got married and she didn't take my last name and to change it now seems to be a big deal here in california.

This looks suspicious even to me. Those people look at everything. You just met and are getting married? Of course it's a red flag. No ceremony is a red flag that you don't want all your friends an family to find out the way they would for a "real" wedding. Not living together? You better believe that's a red flag. It doesn't mean it's not a real wedding because hell, one of my best friends who is a citizen met another citizen and got engaged 3 months later and married 7 months later and they didn't live together before hand but she only feared for her biological clock ticking away and not ICE breathing down her neck. But you definitely should get a lawyer and have a solid game plan here.
