Hmm. About two years ago or so my mom applied for her green card through my sister. However, we filed both applications I-130 and I-485 together, she got her biometrics appointment within a month and around month 3 or 4 she received her work permit, 5 months later she received her green card. FYI my mom was a visa overstayed as well.

He turned 21 on August 1 so it was after.

That’s just weird, I just don’t understand why it’s different for everyone. I know things are worse now with Trump though. What country was your mom from?

question about the I-130 USCIS interview. My dad has his scheduled next month via my brothers petition. He also submitted the I-485 since his last entrance was via work authorization. My question is, the interview is @ local USCIS office but he is concerned that they will ask him to go back to Mexico before he gets approved.

I thought if your interview is in the USA they wont require you to go back and wait 10 days or so for it to get approved. Am I wrong? Also about how long after after interview will he get his green card if it gets approved? Will he get approved right on the spot and just wait for the green card to come or will he have to wait months for it to be approved?

Vista bulletin is what year USCIS is processing applications.. All depending on where you fall. Its the first link after you good visa bulletin.. Scroll down to the bottom. I got this information from my lawyer. Example from said page:

FAMILY-SPONSORED PREFERENCES

First: (F1) Unmarried Sons and Daughters of U.S. Citizens: 23,400 plus any numbers not required for fourth preference.

F1 Applicantions are currently being processed from 2011.

Just to give you an example.. So if you apply today.. youd have to wait until they get to your year.. How they determine how long it will take to process your application. I fall under F2B under my mother, so about 6 years right now before a greencard becomes available to me.

If your notary didn't submit I-485, that may be why she hasn't - and won't - receive a biometrics appointment.

If she is simply a visa overstay, entered legally with a visa, and has never left the US since entering, the notary should've submitted i-130 and i-485 together, unless there's something else unique about her case. Possibly your brother not working, but this is something the notary should've explained to you. You should call and ask for the specifics.

I-130 is simply the petition from your brother as a US citizen, for her. Once approved, an i-485 is needed for her to actually adjust status here. Not submitting them together will extend the process quite a bit

If your dad entered on AP then he's been lawfully paroled into the country. Unless there's any inadmissibility reasons then he will be approved.

In the end it boils down:
1. You are admissible and all documents are in order - you get approved.
2. You are admissible but something's missing - you get an RFE.
3. You are not admissible - you get denied.

USCIS will never tell you to do consular processing, upon denial they can place you into removal proceedings but that's kinda that. They can't just say "hey fuck you buddy I'm gonna deny you because fuck you".

Hey guys .
My mom is going through the same thing, my brother petition for her back in July 2018 and she got receipt letters and biometrics, all before October , I’m concerned because I just learned through my mom that her lawyer might have messed up because she forgot to send her medical exams .. we haven’t heard from USCIS since her biometrics.
