GC or DACA work permit? HELP !!!

Hey guys, I need answers and I'm just gonna get right into it.

To shorten my story;

- I had a deportation proceeding case even before DACA came out.
- I applied for DACA, i got approved and renewed twice already (going for 3rd).
- I got married to a USC back in 2016.
- Started the process for adjusting status to GC with a lawyer.
- We passed our first interview back in 2017.
- My case was finally terminated back in 2018.

After case termination, thats when we finally can apply for adjustment of status. That brings us now, we are just waiting for our 2nd interview date. My lawyer said... it MIGHT take a yr or 2 just to get an interview date, apparently its so backed up right now.

Now my problem is that I didnt think this process would take this long im currently in my 3rd yr !!! and now my concern is my DACA is expiring 5/1/19... i told this to my lawyer but he gave me 2 options for the meantime: apply for GC work permit since i already paid for it (part of the process) or renew my DACA. Problem is he said GC work permit might take 6-12months to process and it only have 1yr of expiration; I know DACA has 2yrs. I'm heading towards renewing my DACA since I dont want to lose that status also and it has 2 yrs expiration date. sooooo my questions are:

1. Does it really take this long to get a GC from som1 who has a deportation proceedings who married a USC? (I'm on my 3rd year of waiting)

2. Should I go for GC work permit or DACA work permit? which one do you guys think is the fastest to get approved?

3. If i do go for renewing my DACA, does having pending GC application complicate my DACA application? Should I mention it in my applicaiton?

4. What should I do??????? **crying emoji**

I need to apply something soon, since i only have 3 1/2 months left till my work permit expires, I have a job and I do need my driver's license. I know this is my fault for losing track of time, but honestly I didnt think it would take this long.... unfortunately it did... and i might have to wait even longerrrr !!! I thot i would have my GC by now !!! I need your help and suggestions pleaseeee thank you in advance !!!

Get DACA, then get GC work permit. Get yourself protected, then add more layers.
Note I am note a lawyer, so grain of salt applies.

Still I'd get daca cause you are going to be out of status if you wait for GC.

as of now I am studying on how to apply for DACA renewal again... lol its been 2 yrs.

unless som1 here convinces me that GC work permit is a better choice... DACA will be my choice.

1. Yes, it can take that long. Having a deportation order can considerably add time because you had to deal with it before you could move forward with your AOS (adjustment of status)

2. You might want to renew DACA. No guarantee you’ll get it before your expiration but it’ll serve you for two years.

3. It won’t complicate your GC app. You can write a letter explaining your situation, but it might be unnecessary. Ask your lawyer

yeah i pretty much waited 2 years for my case to be terminated until we can move on.... but to get the 2nd interview does it take another 2 yrs for me to get a date? I was told that after I pass that interview itll only take 3-6 months to get my GC.... sooo pretty much this interview date is the only thing holding me back atm. sucks.. but it is what it is...

Have you tried reaching out to your congressman/woman? Maybe they can get the ball moving a bit faster

1. No, I got my parents' GC (filed by myself) less than a year even with an RFE (applied 8/2017, RFE 1/2018, EAD 3/2018, GC 6/2018 ), plus spouse is always faster than parents (I've seen as fast as 2-6 months unlike parents 6-12 months).

2. Honestly it depends on how confident you are with your application (if confident just go for GC; if wanna be safe go for DACA and GC). My parents were out of status and they got GC without a problem. IDK why the hell your application got terminated tho.

3. Is your lawyer legit?

Yes my lawyer is legit, he's been dealing with me since 2006. It's so much faster if I dont have deportation proceedings under my case. The only thing that got terminated was my deportation case, we have to terminate that first so we can move on with adjustment of status.

A lot... but money is my least concern since DACA pretty much let me have a decent job.

addon question:

I'm filing out my DACA renewal packets again.... but i just realized we're on a govt shutdown. is USCIS affected by govt shutdown?
