So USCIS doesn’t make a big deal out of that ? If that’s the case. I think either one of the options are good. So that gives a little peace of mind, kinda . Lol
We are hoping that she gets her green card by summer, that would make the case 1yo

I agree with this. I entered legally but chose to send applications separately. Next step for your mom will be an approval or interview. Then you’d send in I-485. Ive been at this for 2 years now because I didn’t concurrent file.

If she is simply a visa overstay, entered legally with a visa, and has never left the US since entering, the notary should've submitted i-130 and i-485 together, unless there's something else unique about her case. I-130 is simply the petition from your brother as a US citizen, for her. Once approved, an i-485 is needed for her to actually adjust status here. Not submitting them together will extend the process quite a bit

That’s what the notary had told us. Not sure why they’re separate but maybe it had to do with my brother being unemployed (update he’s still unemployed, that lazy American).

You’re still processing after 2 years?

Yes if he’s unemployed y’all will have to get a joint sponsor. I am done now. My card is on its way. It took 9 months for my I-130 to get approved. I didn’t have an interview for that. Some people will interview twice. And it took another 10 months to get an interview for 1-485.

We do have a sponsor who’s going to help us.

Just checked online and they’re saying processing times are currently 7 1/2 to 9 1/2 months for I-130. We’re almost at 5 1/2 right now. Ugh hate the wait.

You can file I-485 while I-130 is still pending by attaching the receipt letter rather than the approval letter. You will definitely be delayed a bit because they'll need to put the two cases together but it's better than doing nothing while the I-130 is pending.

Also in general I-130 only has a standalone interview if you married after getting a removal order. In all other cases they just check for three things. Your ID, petitioner's proof of LPR / USC status, proof that you're related to one another.

UPDATE

Still nothing. I’ve been checking the waiting time for a US Citizen to process a parent. For months it had shown that the wait time was 7.5 to 10 months. We just barely crossed the 7.5 month mark last month and now they’ve updated the wait time to 9.5 to 12 months. It’s just so frustrating why this always happens to us. I almost wanna cry from all this frustration. My mom has been here for 23 years and I want her to be done with this nightmare.

All I can say is, you're not the only one. This is ridiculous... basically EVERY type immigration application is taking two or three times longer...
