DACA recipient arrested by ICE because of prior DUI

Brandon Reyes, 23, was arrested for unlawful presence in the country, according to ICE officials. He and his mother were taken into custody without incident at a Grand Rapids residence, and have been entered into removal proceedings in federal immigration court.

ICE officials didn’t say if Reyes’ DACA status had expired, or if he attempted to renew his status. But officials referenced Reyes’ driving under the influence conviction from 2018, which can be grounds for DACA revocation.

Reyes’ immigration attorney, Richard Kessler, said Reyes’ DACA status was good at the time he was detained and wasn’t due for renewal or expiration until this summer.

In November, Reyes pleaded guilty to one count of operating while impaired -- his first offense -- stemming from an arrest by Rockford Police on June 17. He was originally charged with operating while intoxicated but had the charge reduced at his plea hearing.

Kessler couldn’t provide Reyes’ blood-alcohol content at the time of his arrest, but said it was low and there was no crash. District Judge Sara Smolenski sentenced Reyes to one day in jail, 12 months of probation, and five days of community service, according to Grand Rapids court records.

Couple things, this guy made a massive mistake by drinking and driving. This happened just last year. He should have known that the administration is cracking down even on the SLIGHEST of legal issues that Dreamers have. I sincerely hope he can get out of this somehow. Second thing is, lawmakers need to hear this loud and clear, especially Democrats. If they really do care they need to introduce a bill in the House immediately (Pelosi already promised that would be a priority in the House after she becomes Speaker).

Conviction of DUI is a serious offense you dumbfuck. Stop condoning DUI. He's not a baby. He should have known drinking and driving is a no no especially if your ass is illegal and Trump is President.

DUI's can result in revoked Residency or even Citizenship.

It wasn’t a DUI, the courts got him on impaired driving which is a misdemeanor charge in Michigan. I hope this guy can afford a good lawyer and get him out of ice custody. Also to make better decision
