Hey guys! Just wondering if I can use my income as proof too? My soon to be wife did not work much last year so it does not meet the guidelines. I read that I can include my income too? Is that true? Can someone help me out? Thanks!

No, you can’t use your income to supplement an I-864 Affidavit of Support, because the document requires a permanent resident or U.S citizen to support you in the case you lose your job and need help supporting yourself. If your wife didn’t earn more than 125% of the federal poverty level for your household size (ex. $20,575 for a household of two) you’ll need to get an additional affidavit of support from another relative (who is a us citizen or permanent resident) perhaps her parents, etc

The comment above is wrong.

The intending immigrant can use his income to satisfy the income requirement, it's stated in the instructions. As long as the intending immigrant is working legally, as you are with your EAD. Read the I-864 instructions, it is on there. Your wife is still signing as being your sponsor, you are only helping with the income requirement part. She will still be the one responsible for you.

JJ Glo is right. Your spouse can use your income to supplement theirs as long as you're working legally and you live together.

This does put you into a very peculiar position because your spouse is essentially using your income to vouch for you that you will not become a public charge.

So I guess it’s a very good idea to use my income then?

You can. Will your wife work / make more this year? If you apply now and the interview is in 6-12 mos, you might be able to bring new evidence to the interview if anything. My guess is it matters how high above the 125% poverty line you are with your combined income.

At the time I applied, I used my income along with my wife's, but hers was considerably less and she was doing freelance, so we had an additional sponsor just in case (mother-in-law)
