What if employer asks about DACA

Given Trump and this year's election, employers seem to be especially keen on visa statuses etc. If I was to interview at a job (mid-size boutique firm in corporate America), where they have already been informed ("What's your visa status-designation"? to which Ive already replied "I am free to work for any employer and have work authorization and do not need sponsorship etc") via email...


Lets say I am interviewing in-person, what should I do if they ask?
and what are the different ways in which this can come up?

Would hate to be out of the running just bc of my DACA status

I once had someone be an asshole to me when recruiting for software engineering jobs because I was a DACA authorized for work. They were like whats your visa status. I said authorized for work for any employer.

Again, whats your visa status. I again say authorized for work for any employer.
Then they got audibly annoyed and hung up. Good grief.
I do not work for assholes.

You give me a fair treatment, and fair pay for my large skill plus credentials and work experience, and you get good quality code. Be an asshole to me, and enjoy your third world outsourced to indians who work as software engineers cause they have to cuz poverty, not cause they want to, code.

Should of immediately reported it to corporate and even the CEO. Get that cunt fired.

And isnt it illegal for employers to be asking too much about status?....

I'm not entirely sure, but given the speaker on the phone sounded foreign it is likely its one of those Indian contractor companies.

I would've reported it, but I didn't think to do so at the time.

Since we don’t have legal status, but lawful presence, many important hiring discrimination laws don’t protect us. Just because we have a work card doesn’t mean we are protected from a lot of things. Employers can deny you work base on 2 year limit, they can even deny us work because we have DACA. I’ve had companies straight up tell me they need someone who can stay more than 2 years and even if DACA is renewal there is no guarantee it’ll be there next time or there is no guarantee my application will be approve. There is nothing stopping an employer from googling what C33 is or knowing a 2 year work card is DACA.


They can even subtle about it “this job requires travel outside the USA”



But nothing bars you from submitting an application, apply and see what happens. If they ask tell them you have a valid work card and don’t require sponsorship.
