DACA with removal order

Hi guys,

I don't know if anyone ask this before or not. I have DACA and renewal is pending. I also have removal order. I am married to USC and have 2 USC children. I am trying to adjust my status but my lawyer says he wants to do joint motion to reopen and that is hte best way to adjust my status. after filing for Joint MTR the Government prosecutor replied "its not the right time" and thats it. My lawyer says then wait. It is getting frustrating and scary for me and my family. Any legal advice will be greatly appreciated.

FYI.. DACA expires in Sept 2020.

If JMTR fails then the next step is to petition the court directly for another reason including asking for sua sponte reopening, then try the BIA if that fails, and then go up to the circuit court if that fails.

Get a different lawyer, anyone that tells you "then wait" is a quack.

From my understanding, government lawyers are being told not to do most joint motions and to appeal everything. Judges are also scared to oppose government lawyers as well due to Justice Dept rules.

Don't think there is an independent EOIR for this reason. Although the government attorney has said no, the lawyer can still petition EOIR directly.

Note two things if successful;

1. Cases load is very extreme right now dependent on location, but waiting will make it worse. EOIR case load is expected to increase dramatically in the coming months.

2. Have an expectation that procedure has changed dramatically in EOIR under the current administration.

Thank you for the feedback. Hope this administration will be change in 2020. It's very gloomy with this administration for my family.
