I cant wait to see all the trumpsters on this forum respond when this administration litteraly fucks us. If he losses he will undo all of obama EO's by the time he leaves office. He will be voted out in Nov, the prob is he will take DACA down with him as a f u. And all the dreamer trumpsters are gonna do some crazy ass mental gymnastics of explaining how this is good for us.

Honestly he needs to be careful with that due to the fact that Congressional Review Act exists. If the current polling holds with Biden sweeping the traditional blue wall + AZ + NC + probably other stuff the senate will definitely swing too, won't be a huge majority but you only need 50+VP in the senate to pass a law withdrawing whatever regulation his USCIS would put into place (e.g. withdrawing DACA) and that point DACA is permanently solidified and would need an actual law to get rid of.

It might be advantageous with that an "arriving alien" can file for AOS with USCIS notwithstanding a removal order or pending proceedings but travel with AP while in proceedings or subject to a removal order is pretty much unsafe.

Basically, you don't have much to gain from doing AP as an overstayer.
So if a visa overstayer who utilized AP multiple times were to adjust one day, they would use the latest entry on parole to do so not their original i-94?

I really think a good immigration attorney would be able to give full proof answer to these questions.

These are not questions you need a lawyer for. You always use most recent I-94 for adjustment purposes. Might come as a huge surprise but most people are able to travel freely.

You just seem very knowledgeable about these things. You'll be surprised. People who have no sort of record/crazy issues hire attorneys and pay them upwards of $2K just to fill out and send DACA renewal documents.
