In order to adjust you will need 245(i), without that, you will probably need an I-601A waiver. Final question is how old were you when the I-130 was filed and was it actually pending for 5 years? If it was filed while you were under 21 you are most likely protected by CSPA and would be able to go via F2A rather than F2B.
I have 245i and my dad is a US resident I know he can file for me but is the timeframe still like 20 years since I am older than 21?

F2B backlogs are currently:
About 5 years for majority of the world
About 21 years for Mexico
About 18 years for Philippines

Unless you're from India getting employment sponsorship rolling wouldn't be the worst idea.

- Waiver of Unlawful Presence $1,050
- Affidavit (Application) $500
Wow, my waiver alone cost around 6k. Make sure that they actually know how to do the i601A waiver. Any run of the mill attorney can do the i130, but the waiver is complicated, and you want someone with a lot of experience (especially if there is no clear cut hardship).

Quick update. I decided to consult with 2 other highly reviewed attorneys (at least according to Google).
Attorney 1: We can make a case for you by consulting with a therapist and building that report. However, guy lives in LA and charges $14,000 for the entire process. Also didn't project integrity to me, seems like a Better Call Saul type guy.
Attorney 2: Since I don't live with my parents, they do not have any major health conditions, and there is no clear case for extreme hardship, he is not comfortable taking my case as he believes it will just get denied. Seemed honest and straight forward, but frankly, it didn't seem like he wanted to put forward a lot of work into this.

That leaves me now back to square one. I will probably try to find examples of instances where extreme hardship was proven, and try to see how I can build that up in my case. Any further suggestions you guys have would obviously be much appreciated.

$14,000 seems extreme.

I live in Texas and have gone through a very reputable attorney for my semi-standard I-130. The attorney was recommending that I would do a 601a before I got married though and she doesn’t charge much. Since everything is done online now (Covid, etc) - she might be able to help you wherever you are.

Agreed that $14,000 is overkill. Frankly, at that point I'd just rather try to wait out to see what will happen in November, or get married/move if that doesn't work.

And I will take your offer. Would you please share the law firm with me? Also I guess if anyone else has gone thru I-601A through family and without a strong case for it, please let me know if you have an attorney you recommend. They don't have to be local.

My case was like that too. Obviously I do not know the details of your case, but I live across the country from my parents, they do very well financially and thankfully no major health problems. I was still approved without an RFE. Keep researching attorneys or dm me if you want my attorney's info (We consulted over 10 attorneys throughout my immigration process and she's been the best, in fact I'm using her again for my husband's case who is a DACA beneficiary)

Yeah my case is pretty vanilla. My parents do well financially, no major health concerns, etc. I just DM'd you by the way
