This is interesting - would TPS status be safer?

A lot of people are tweeting about #DACA. I am very happy for the Dreamers! To be clear, if Congress won’t protect Dreamers, the safest way is NOT to restore DACA—which can be stricken by conservative SCOTUS—but to say due to COVID that all here before March 2020 get TPS.

It is a statutory authority that congress has given the president in his total discretion to use as opposed to deferred action—whose statutory basis is not enshrined but is generated by implication

TPS would definitely be a step up from DACA.

Yeah TPS would be safer because it's codified in law, it is an actual non-immigrant status, generally comes with automatic extensions due to re designations, and in 6th and 9th Circuits a grant of TPS is enough to qualify for AOS since those courts have ruled that a grant of TPS is an admission to US.

You want to stretch it a bit further, it could in theory make you eligible for AOS under 245(k) via work.

Don't get our hopes up! TPS would finally legalize us and allow us to adjust status by other means.

Update: Nevermind, looks like I was wrong. The 10 year ban would still apply.

Late 40's Dreamer (Holy Fucking shit I'm almost 50 and still dealing with this), aged out of original DACA and didn't have a chance to apply for extended DACA after Republicans killed it on the vine.
